2018年2月18日,第13/2017号法律《修改〈民法典〉不动产租赁法律制度》开始生效。该法律是澳门1999年回归后,首次对《民法典》建立的不动产租赁制度进行的修改,法案在提出、讨论及表决阶段,都在社会各界引起了热烈的讨论和巨大的反响。本文通过简述贯穿葡萄牙不动产租赁制度的“约束主义”(vinculismo)思想之起源、演变及落实,以及分析其对澳门不动产租赁制度的影响,确认带有“约束主义”色彩的不动产租赁规范在澳门法律体系中一直存在,而本次修法的提案者亦有意加强此思想在租赁制度中的体现。由此引起的争议,本质上与基本权利的价值衡量有关。针对上述长期处于冲突之中的基本权利,本文将提出能合理衡量有关价值标准的可行建议。
<<The Amendment of the Legal Regime of Real Estate Leasing Provided in the Civil Code(Law No. 13/2017)came into effect on 18 February 2018. It is the first amendment brought to the legal regime of real estate leasing laid down in Macau Civil Code since Reunification in 1999. Throughout the stages of proposal,discussions and voting,this Law has never ceased to arouse controversies and attention among various sectors of the community. By briefly presenting the origin,evolution and implementation of the idea of binding regime(vinculismo)that permeates Portugal’s legal regime of real estate leasing,along with the analysis of its impact on Macau’s regime,this article confirms that real estate regulations characterized by binding regime have always existed in the legal system of Macau. The proponents of this Law intended to reinforce this idea. The nature of the controversies triggered by this Law is essentially related to the measuring of the value of fundamental rights. Regarding such fundamental rights which have been in constant conflicts,this article provides feasible suggestions of the criteria for measuring the value of relevant rights.
