新《民办教育促进法》及相关配套文件明确了对民办教育实施分类管理,确定了今后我国民办教育改革和发展的基本方向,是我国民办教育领域的一个具有重大战略意义的制度创新,有利于破解民办教育发展的瓶颈,有利于地方政府扶持政策落地,有利于拓展民办教育发展的新空间。2017年9月1日,新《民办教育促进法》实施以来,全国各地正在抓紧制定地方性政策法规落实民办学校的“营”“非”选择,虽然有辽宁、江苏、上海、河南等10多个省市出台了地方性政策,但是仍然有部分省市表示正在学习中。从国家和省市政府已出台的政策来看,对民办学校“营”“非”选择面临的“法人属性、财产归属、退出机制等”核心问题的政策定位仍然比较模糊,导致民办学校举办者对“营”“非”选择心存顾虑。民办学校的“营”“非”选择顺利实施需要立法机构及相关部门加强宣传与立法解读、营造良好氛围,各级地方政府在国家顶层设计的基础上做好一系列科学的、更加精细化的制度设计,更需要地方政府对“分类管理”新政的理解支持和积极配合。
<<New“Law of the People's Republic of China on Promotion of Privately-run Schools”and relevant supporting documents have specified the classified management of private education,thus setting the basic course for the future reform and development of private education in China. It is an institutional innovation of great strategic significance in the field of private education,which is conducive to the removal of bottlenecks in private educational development,the implementation of supporting policies of local government and expansion of the new space for the private educational development. Since the implementation of“Law of the People's Republic of China on Promotion of Privately-run Schools”on September 1,2017,local policies and regulations have been formulated all over China to put in place private schools' choice between“profit-making”and“non-profit-making”. In spite of the fact that over 10 provinces and cities,including Liaoning,Jiangsu,Shanghai and Henan,have formulated local policies,some provinces and cities are still standing on the sidelines. The policies issued by the national,provincial and municipal governments still offer ambiguous policy positioning of the core issues facing privately-run schools concerning“the attribute of legal person,property ownership and withdrawal mechanism”,which results in the privately-run schools' doubt about the choice between“profit-making”and“non-profit-making”. In order to help privately-run schools make wise choices,it is demanding for the legislative institutions and relevant departments to strengthen propaganda and legislative interpretation and create a favorable atmosphere and for local government of all levels to carry out a series of scientific and fine institutional design on the basis of the national top-level design and to understand and support“classified management”.
